NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain mortgage given by David J. Annese and Michele L. Annese to First Independant Mortgage LLC, dated June 5, 2006 and recorded with the Essex County (Southern District) Registry of Deeds at Book 25749, Page 357 as affected by a modification agreement recorded with said records at Book 29714, Page 120, of which mortgage Deutsche Bank Trust Company Americas As Trustee for RALI Series 2006-QS13 is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at Public Auction at 2:00 p.m. on April 11, 2012, on the mortgaged premises located at 40 SURREY LANE, PEABODY, Essex County, Massachusetts, all and singular the premises described in said mortgage, TO WIT: EASTERLY by Surrey Lane, 154.02 feet; SOUTHERLY by lot 180, as shown on plan hereinafter mentioned, 110.00 feet; WESTERLY by part of Lot 176, as shown on said plan, 184.84 feet; and NORTHERLY by land of United Shoe Machinery Inc. and the Middletown Town Line, as shovvn on said plan, 114.24 feet. Containing 18,637 square feet of land. Being Lot 181 on the plan entitled ''Subdivison of Land in Peabody, Mass. Knollwood Heights, section II'', dated October 15, 1962, drawn by Dana F. Perkins & Sons, Inc., Engineers, and recorded vvith the Essex South Registry District Deeds in Plan Book 100 Plan 26. Said premises are conveyed subject to and with the right to use streets and ways shown on said plan for all purposes for which streets and ways are commonly used In the City of Peabody in common with others entitled thereto. For mortgagor's(s') title see deed recorded with Essex County (Southern District) Registry of Deeds in Book 25749, Page 355. These premises will be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
