we were about to close on a home but come to find out there is a lien on the home. Can we back out without losing our deposit?

You really must speak with your agent. Both agents must discuss this. When we do short sales we are working on lein releases. The listing agent cand yours both must see what needs to be done. They know what the lien is and how it can be released.
