Senior housing gets an exemption to the Fair Housing Act's prohibition of "familial status" discrimination against households with children.
Communities are considered senior housing if the units are 100% occupied by persons over 62 years of age OR 80% of the occupied units are occupied by at least one person 55+.
Since 20% of the community CAN be family with children, these families can be restricted from certain community benefits senior households have access to. Additionally, the community DOES NOT has to allow any families with children.
