If you are the property owner, and do not disclose serious bad issues about property, are you responsible for the damage?

FYI!!!!! This house has SERIOUS damage due to water leakage in basement, especially in spring when snow melts. Hurry and sell this property before spring so you don't have to pump out several feet of water!! Mold can SERIOSLY make children sick, and could even kill them. I suggest new property assessment for tax purposes and sell as LAND ONLY! To fix this house would cost a FURTUNE. Has the mice and dog feces been serilized yet? ( I know this house personally---I used to live there along time ago...I just removed my childrens belongings full of mold and mildew after the ex-husband forclosed on this property. This info is TRUE and CORRECT!)

Hi Lenora -

The simple answer is YES! The owners should disclose all known defects as should the listing broker. As Realtors we are not allowed to tell you how to disclose defects or what qualifies as a defect. We do have state approved forms known as Real Estate Condition Reports that we provide sellers to help in the disclosure process. In addition to what the Owner discloses, we are required to disclose defects that the owner has not disclosed (or perhaps not properly disclosed).

One thing to keep in mind though, disclosing defects does not necessarily keep you from getting sued. It may certainly help you fight that legal battle - but nothing can stop someone from actually suing you.

Let's hope this one works out okay for whoever buys the property.
