I would advise you to take a look at California "Landlord and Tenant Laws" at http://www.dca.ca.gov. It's best to be informed in order to protect yourself, now..and in the future.

It all depends on the rental contract. The best way to go about it to seek the advice of a landlord tenant attorney. Evicting a tenant can be a lengthy process, hire a law firm that specializes in evictions. When serving a eviction notice, you got to it properly, or you can face fines and additional costs by the court. Good luck.
