I have an empty lot in miller place, town of brookhaven LI NY which builder said could not get a building permit. How to make saleable?

If you cannot get a builder permit, it may have value as a parking and/or storage location for a contractor or landscaper. Often they are looking for places to park vehicles and unbuildable land can sometimes fit the bill.

If this is not a buildable lot which is possible. The lot is still saleable it is just a matter of value. consider neibors as potential buyers to expand their holdings. Some lots can be transfered to the town for rights to build on other unbuildable lots. You could fight the town for the building rights depending on the reson for rejection. Your question how to make it Saleable... it is salable... just a consideration as to the value of that property and who would be interested in the lot.

I am curious as to the size of the property. That in itself could be the problem. Bob, as was stated by Dorothea, there are many reasons why property would not be deemed buildable. My thoughts would be to investigate other areas of interest for a lot of land to gain value other then for building purposes.

I would love to give you a quick answer and easy resolution to your situation, but that is not possible.

My first course of action would be to get the documentation from the builder as to why he was not able to get a permit to build. At that point, I would approach the building department in the Town of Brookhaven to find out what you could do to meet the zoning requirements for what you are trying to build. What is the property zoned for, are you asking to build something that is not within the requirements?, can you get a variance? Does the denial have something to do with environmental issues? All of this is assuming your builder went through the proper channels and has documentation of a denial for a permit.

If your builder does not have the information for you, then I would go directly to the building department to see if the information you were provided regarding the inability to get a permit was accurate.

Seek the advice of your attorney based on the answers and documentation you get from your builder and/or the zoning department in Brookhaven.

You can contact the Brookhaven Town 631-451-Town and ask for "Zoning Department", you can stop by the town or send them the fax with property infrmation, it might take 8-10 days to get the answer.

Not knowing why one couldn't get a permit--have you contacted the town yourself and inquired, if not consider doing so, and check to see what usages the lot may have--what is your agent and or attorney advising....

The question would be ... what was the builder looking to put on the lot. What is the zoning?
