I don't understand your question. The property is not on the market nor has it sold in the last 12 months?

If it were and you were buying it from a seller you would want it delievered vacant, if you are buying it from a lender you would want it delievered vacant, if you are buying it at foreclosure, and it is occupied, yes it could take time to evict any party that is living there.
