Can we get a copy of the Seller Property Disclosure Statement for this property?

The disclosures in Arizona are to be provided within 5 days of Contract acceptance in the most widely used contract in Arizona. Once in a while we see them before contract but more often than not they are viewed during the 5 days after acceptance.

The 2 typical disclosures that are called out for in the contract are the Sellers Property Disclosure Statement and an Insurance history report (Clue).

The most widely used contract also provides for a 10 day Inspection period for the buyer to have our Home Inspection, Wood Infestation completed etc. It's during this period that we as the buyer review everything and decide to either move forward, request repairs or walk away and get our earnest money back.

Personally I'm a proponent of providing the Disclosures before contract but the support for that has not been adequate to shift the practice.

Lets go view the property, with our collective experience I expect we can discover a majority of the flaws and be informed as to the condition of the property prior to ever moving forward on anything.

In addition, the seller is not requied to give the seller property disclosure statement until five days after the contract has been accepted.

The Seller's Property Disclosure Statement is available, however this house is Pending (Under Contract) as of 9/1/2012.
