Are decks outside individual units always considered limited common elements? Who determines what the common & Limited common elements are in a?

Hello Mark,
the answer is within the Condo Master Deed. All of my experience with condominiums at the shore is that
the decks are usually considered common area.

Mark,
Decks are not allways a limited common element. You need to check your documents for the association. It will spell out clearly what the limited common elements are. You might want to contact your association atty. and ask the question. They know the paperwork the best.
