It is possible to remove your wife from the mortgage if they sell or refinance. It sounds like they needed each other to qualify and therefore they are both on the loan. At some point your wife was removed from title. That does not relinquish her from her obligation to the loan/mortgage.

The first legal action or the notice of default (NOD ) is recorded by the court recorder at the county court house. However, if your landlord is telling you that he is in foreclosure, I not sure what you want to check. If your landlord has received the (NOD), the foreclosure will take about 120 days from that date, if the landlord does not try to defend his postion or try to sell the property or complete a short sale if the value is less than the debt outstanding.

In Texas you would check with the county recorder if a NOD has been filed (Notice Of Default). It is a matter of public record but you have to go there to get the answer. Then you ask the landlord about it. Sometimes it just means that they were late making the payment that month so they may have caught up with the payments.... more
