- How long will the process take?
- Can I continue to collect rent during the short sale process?
- Can I avoid a deficiency judgements from 1st and 2nd TD holder?

These issues remain the same whether you sell at $300,000 or $400,000 - by definition, on a short sale the seller receives NO PROCEEDS - all the money goes to the creditors.

I personally live North of Alvarado in the Historical Lincoln Park area. There are pockets of amazing and beautiful homes in Pomona, especially in the Lincoln Park area. The homes have so much character and charm, and it feels like you are living in a little community back east somewhere. What no one wants to tell you is - the buyer's agent has NO CONTROL over the short sale process. It is all in the hands of the listing agent and the negotiator they use, if they do not do the negotiations themselves. The only real advantage to having an agent that understands short sales on your side, as a buyer, is they can interview the listing agent and know if that agent has any clue what they are doing. This will keep you from making offers on properties listed with agents who will never be able to close the deal. For example, I have a client who was interested in a short sale listing. I called the listing agent and after 2 minutes on the phone with her I found out her seller had no true hardship, has not been willing to sign any offer she has brought them, continues to collect rent from tenants in the property and not pay the mortgage, taxes or insurance, and she has never closed a short sale. My clients, based on my advice to them, decided to pass on even viewing the property. This was a very good decision on their part.
With all that being said, even the most experienced short sale listing agent/negotiators lose a few every now and then, through no fault of their own. Hope you find a great a agent to represent you, negotiate a great deal for you, speak the listing agent/negotiator's language so they can tell you what is truly going on and help keep you out of making offers on deals that will never close. In the past, many sellers would tend to shy away from FHA offers. That is no longer the case. Many loans today are FHA and go very smoothly. Sellers shouldn't be afraid to entertain FHA offers.... more
