The best way to find out how much house you can afford is to talk with a qualified lender who can help discern not only how much of a mortgage you can afford, but what your monthly payment would be including principal, interest, taxes and insurance, etc. They will also help you find out your creditworthiness and if it needs improving, how to do that. The Answer depends on your contract. If you had a home inspection contingency in the contract then you had dates to have inspections completed and a date to send addendum requesting repairs. If the items were not uncovered on the inspection but after the inspection you might have a challenge but if items came up on final walk through and were defects that just showed up then you have a case as long as your contract doesn't say as is purchase.
How did your home inspector not find these issues, sounds like stuff that was wrong before you even submitted purchase contract.

The Seller's agent should have informed the Seller that there was a possible offer coming. However,it is up to the Seller's sole discretion to wait, or act on an offer in hand. If the terms of the offer already received met the buyer's bottom line, came with solid financing and met the closing terms that they wanted they may have opted for the "bird in hand". As a listing agent I PREFER to let agents know when I have an offer in hand, and with the seller's permission I do so. However, I have had many agents promise offers that did not come to fruition OR they have stated the don't want to "get into a bidding war". So it's a fine line to walk here and should be at the Seller's sole discretion with full disclosure by their agent.

Who the liable party is depends on how much the seller knew before the transaction and if there was anything mentioned in the contract about the tree. If the buyer knew about the tree needing to be removed before they closed the sale, they should have made sure it was put into the contract. I agree with several people on here though. It's a question that should be directed to the agent. They'll know the details of the purchase.
