Were you present for the building inspection? Normally an inspector will go on the roof and take a look at any crawl space under the roof if it's accessible. Did that happen? If so, why not? That seems like a pretty major thing for an inspector to have missed. And how would the inspector not have seen any associated internal damage as well?
As far as having a case, it's always difficult to prove what someone did and didn't know. You can talk to an attorney but you'll be paying legal fees until/unless you win a court case and you may well never collect anything even if you do win. Ta(k)oma Pk has strict code enforcement but if everyone understands and follows the policies it helps everyone. A landlord class is required for a license. They provide a sample lease I highly recommend, we use it with all tenants. Like DC, tenants do have very clear rights and landlord concerns about costs have also been taken into consideration and adjustments were made to allow for appropriate rental increases for single unit rentals (ex. basement apartments, sharing a home). If you want to convert a basement into a rental it is not always a "given" and that has frustrated some homeowners.... more
