A lot of people want to ask Realtors legal questions. We're not lawyers. We can't interpret the law, review contracts for anyone other then our real estate clients, etc. You really need to talk to a good real estate attorney. Sometimes, in some areas, the Bar Association will have a lawyer referral service.

Condos qualify, but you may not. You cannot have owned a primary residence for the last 3 years. You may qualify for the $6,500 Move-Up/Repeat Home Buyer Tax Credit. Check the websites noted in other answers below for the criteria for these credits. Of course, the advice of a tax expert might be better.... more
