This is too difficult to answer the closing attorney would be the person to speak with if you are not represented - It would depend on what the issues are exactly and what is exactly needed to clear the title. Are you represented? This is not helpful if you do not have anyone representing your best interest.

Most lenders require that you have at least a 620 credit score. You could put 3.5% down and qualify for an fha mortgage. i've rates as low as 3.25%-4% It's best to speak with lender to find out if you would qualify for that rate. If you would like I van refer you to a lender.

I have seen where it takes up to 2 months to clear a title so it depends on the problem but it should not be too difficult to find the original owner because of the internet. The attorney should be to the original owner and explain the situation to them and I think that the previous owner will co-operate. I would think that it would be a personal preference, but I personally would choose the wooded lot. Having water in the back yard comes with it's own set of issues (child safety, animals, snakes, mosquitos, etc.) I wold also ask myself, "If I am selling this property in the future, what will potential buyers think? I would be willing to bet that they would have the same reservations that you do!
