Jorge, your new question would likely turn on CA law, but I would be surprised if they would be restricted. If there's a violation they would need evidence to enforce the covenants, but CA may have some bizarre rule against that.
To answer the original question, I think you could clearly take the picture, as long as it's say not peering into private areas. The real question is what you can do with that picture. If someone appears in the picture, it probably wouldn't be a good idea to make it a listing picture which is published on several sites on the Internet.... more
