Although a slow moving property can be an indication of defects in its condition, there are other possible reasons too. The first reason is also the most likely -- it is over priced. If a specific property is priced above what the local market conditions will bear without unique features or location factors to support the price, the property will linger on the market until the seller gets frustrated. A second reason may be the uniqueness of the local market.
Although I now sell property in a robust urban market, previously I sold real estate in a rural vacation home mountain community in West Virginia. Unlike in urban areas where buyers are constantly moving in and out of an area for jobs, no one "needs" a vacation home, so a sale is completely dependent on the right buyer at the right time. There we rarely saw properties sell within the first 30 days on the market, and my rule of thumb to sellers was that we may have to see the property through three of the four seasons of the year before reassessing. Of course, if in the first two or three months there were buyers in the area by no showings for this particular property, that was an indication that it was priced too high.
A third reason for a slow moving property may be tied to the local job market. For example, If there are few jobs bringing folks in and out of a particular rural area, a property that is likely to be used as a primary residence may move slowly even if it is in perfect condition.
So, what you really need to evaluate is if the property you mentioned that's been on the market over 120 days as outlier from the pace that other similar properties in the community have sold. If not, it may have nothing at all to do with the condition of the property.
Attorney's do not just ask the title company for a search, the review the search itself. Attorney's work with title companies on a daily basis. They are knowledgeable about documentation and what it should and should not detail. Depending on the state that you live in, if you were to request a title search directly, their might be additional fees incorporated that are waived when an attorney files it.... more
