paying the mortage ontime since we split up because he doesnt want the home and he wants me to get it out of his name. What should I do?

Hi Erica,
You should speak with a real estate attorney to get a clear picture but I think that you need to refinance the current loan under your name and transfer the deed to your name. Since your ex fiance wants out I think he'll be happy to go through with the necesary steps.

FIRST ANSWER

Erica,

If you want the home your only option is to refinance the mortgage into your name. At the same time you must get him to quit claim his interest to you (the closing/title comany can handle this for you). If he doesn't you will be in the worst position possible which is that you have to pay for the house but he has legal rights to it and you can't sell it, etc. without his permission.
