How to transfer a property if there was no will? Need a Home Improvement loan for repairs

I live in New Jersey and my mother died 3 years ago and did not have a will and at first a lawyer had advised me as long I pay the morgage and property taxes there would be no problems but now the house needs work on it and I can't even get a loan on the property because she is no longer alive

Someone will have to be the administrator of the estate. If you have surviving siblings then there's some addititonal forms you will have to fill out. You can visit the sire at http://www.co.camden.nj.us/surrogate/ forms are downloadable. However I suggest you call them and tell them your specific situation. They will walk you thru the process. Once you have gone thru the process I can assist you in getting a loan for improvements. Feel free to give me a call. I'm assisting another client with similiar circumstances.

Sorry to hear that.

I knew a few similar situations before. Before I share what I knew here, I should mention you to talk with attorney. Make sure the attorney is professional and experienced on this particular field. And niceness is important in your case too.

Yes, usually not absolutely, lenders just focus on the payments whatever who pays there. If the repairs will not cost you too much, you can pay it by your personal credit line. Later on, after court starts your probation case, you may try to use the court paper to deal with some lenders even the title is not under your name yet. I can not guaranty it but you may take a chance.

You should talk with CPA too. That would be very useful for you. You may get some tax benefits as a house owner. Again, I do not guaranty it.

Attention, i donot know in NJ, but in CA, I always mention people to make sure the good title in this kind of circumstance. Also in CA, we have parents-children property tax benefits from county assessor offices. How about NJ?

Finally, do not forget to change the name on the utilities bills, telephone bill, cellphone bill. and you have to remember the AAA card, bank accounts, credit cards, and any other membership with late payment penalty.
