Dad had no will, brother lives in house and will not split Dad's estate. What can sister do?

Brother was signed to half of house. Pension was in Dads name. 401k was in Dad's name. There are three children, all adults. How can we get our share?

Renee you need to get a good Probate attorney if you father had no will. Good luck it can be a long and drawn out procedure.

Your best bet is to consult with a Real Estate Attorney. I cannot give legal advice, but I think it is your best bet. If this was something outlined in a will, present it to the attorney.

Unfortunately, there is no easy answer here. You'll need to consult with an Estate Planning attorney in your area. In Hawaii, the probate law is very aggressive. It varies state-to-state. Probate can be very lengthy and expensive. Sometimes, in Hawaii, probate court forces all the family members to move out while the ownership is being disputed. These are very important legal issues that need a qualified local attorney to answer for your particular family. My sympathies to you and your family at this difficult time.
