seller of house is also realtor, who pays my agent's commission, me or owner of home since he's an agent too?

FIRST ANSWER
Is it listed in the MLS? The realtor should be offering out a co-op. Have your realtor contact them and ask for the cooperating broker agreement. This will be signed by that broker and state that commission payment.
