What happens after the contract is signed to list the house if one of 3 sellers decides they now do not want?

Hi Steph, agree with others - the listing is the formal agreement to promote/market the home. The larger issue is whether you sellers collectively want to sell.

Other responders are right, if an offer does materialize all owners will have to sign off in agreement to the offer and so the listing could remain live and offers simply not accepted if they come up, but that seems silly. If it is clear that you do not have the agreement of all ownership parties to sell, then make that known to your agent/broker. It could make sense to withdraw the listing from the market.

The question as to your position if 2 out of 3 owners want to sell is a legal question to take to your attorney.

Attorney time. You have ownership rights. You have others with the same rights who are on a different page. Negotiation may work but only if you know what your rights are, and theirs as well. It can be sticky. That's what courts and lawyers are for. Sorry

The listing is only that, a listing. If a contract comes in on the property all owners must sign the sales contract if the home is to be sold.

Steph,
Without knowing the circumstances surrounding your property, you may want to consult with your Attorney.
You can't force someone to "sign on the dotted line", so unless that party agrees to an offer when it is presented, you will have some issues to resolve.

Hope that you get a prompt resolution to your problem.
