What are the laws/standards for listing a room as a bedroom in Rocky Point, NY?

If you have a room with heat, a closet, and a window that can be used as a fire escape but it only 6x8, can it be listed as a bedroom? Can a room with heat and 2 windows but no closet (closet is in hallway) be listed as a bedroom?

**size of septic tank is unknown, but the house was built to accomodate a family of 5 back in the 1950's for summer vacations

The ICC 2006 International Residential Code states: no habitable space may be less than 70 square feet.. 6X8 is 48 SF - The Town Of Brookhaven in which Rocky Point sits.

Most codes describe usable, habitable bedroom space as having 7.5 feet of head space with a minimum room dimension of seven by ten square feet. Bedrooms can be invented in a variety of spaces but they might not have enough headroom needed to qualify as a true bedroom.

Short answer is - No.

Go to the local Building and Safety office and ask for a copy of the build permits.
Some older structures may have grandfathered aspects that although they currently do not meet building code, did meet codes at the time of construction.

Generally speaking a bedroom is required to be 8 x 8, have a window large enough for a fireman to crawl through, and a closet. However, in terms of value, calling it a den "that could be used as a guest room" might make sense.

Talk with a Realtor who knows the local customs.

In Illinois, each community can have it's on definition on what size a bedroom would need to be to be considered a bedroom. However, the appraisal standards is that a bedroom must have a heat source, a window and a closet. If any are missing, it would not be considered a bedroom. I have listed some really old homes, where the closets were in the hall way, but I referred to them as "bonus rooms". Hope that helps.
You might want to contact Brokers in your area and get their opinion. If 2-3 say it is not a bedroom because of the size and lack of closet, I would consider that they would know.

A BR must have a closet to be a BR. Otherwise, it's a study/den/bonus room - whatever.

I'm not sure if there is a specific minimum size though ... that 6x8 is really small. Your town will have codes that govern that - easy enough to check ...
