We sued the homeowners assn., a year after we sold. Did we have to disclose?

. We sold or home that was in forclosure. It was sold 'as is". We filled out a sellers disclosure agreement. In it asked the question, "are you in a lawsuit with ....?" We said no.Per the advice of our agent. A year later we filed a lawsuit with the homeowners assn. and it's board members for harrassment of my home daycare, etc..,while we lived there. We never intended to sue the HOA, because we did not have the money. Turns out the buyers also diliked the neighbors, soon after buying the house. They put the house up for sale. Did we have to disclose that we "might, someday" sue the HOA?

FIRST ANSWER

You should disclose what the issue was and how the neighbors and HOA responded. You don't have to say that you considered litigation as a remedy.
