The condo above us had a water keak for several months until the pipe finally burst.This caused water and
mold damage to our unit.The owner of the condo refuses to answer our letters to him.His unit is rental property and he is a licensed california agent. He has listed his unit with Keller Williams VIP properties and is attempting a short Sale to avoid paying the damages not covered by my insurance company,Paying the insurance company, and for damage to common areas.He claims he has no insurance.Is it ethical for the broker to be part of this?

I am standing by my post to your previous question. He should be reported to the Dept. of Real Estate, the Southland Regional Association of Realtors, and I would call his broker. Realtors selling their own property are NOT covered by their Errors and Omissions insurance, so the broker is not directly affected, however this Realtor is in violation of DRE and NAR rules and regs. Hi Ralph,
The HOA should be made aware of this situation because it affects the structure of the building. Even though it was the interior of your property that was affected, the plumbing and mold problems might extend to other units. And if your damages that were not paid by your insurance company is $5,000 or less, you can always go to Small Claims Court . After your repeated attempts to no avail with the unit owner. It's time to get the HOA involved and as a final resort, seek an attorney.
