I sincerely apologize then for misunderstanding your response below. You are absolutely correct, and hopefully Dobie and others who may come across this post will now understand just how complex each situation is.
So without confusing you even more Dobie you are correct when examining the 1st mortgage only. Once the sheriff sale happens they can not change course and try to go the judicial route.
And the other Chris is correct. I can only talk to you about the foreclosure process as it relates to my profession of short sales. You should always seek legal advice before taking any action.
