I would strongly suggest you consult an attorney in the area. If you like I can send you at least three that would be able to help you through your process . With family it is always better to seek professional council, that way they will stay family longer.

no....assuming all of you are on the deed...call a local title co. and ask them to do "pre-title" for an fsbo..if you go thru with it or not...doesn't matter...there is no charge..however there is for a search...that will show who is in title and any liens, or encumberances....anyone who shows on title can list and sell the house...but cannot transfer deed withou the other interested parties signing as well.....bob mcclure- mortgage now- farmington, michigan.almost 14 years of experience, and i am licensed in your state. In most cases all those on title need to approve the sale. It may depend on the type of tenancy (ownership). I would strongly suggest you speak with a real estate attorney regarding this question. My guess is if this is a problem, then there will be a good potential of other legal entanglements that may pop up.
