(he is very sick and in Hospice)..and i am soo confused.... working on a loan mod. with NACA.. to put me in a normal 30 yr. fixed...Dad's villa is free and clear... can't rent Dads villa (they do not allow renters) and selling it in THIS market..shame... I have been told many things..and i am just so confused..I am on disabilty and this is an EXTREMLY aggravating situation for me... Been told.. walk away ( but i do have some assets)...which means i have to start juggeling $$ around.. to who..i don't know...was told they look back around 12 months)....was told to do a short sale..but then people tell me that's a scam.. and I will get a judgement.. as who eats the difference in $ of what my condo is worth and how much I owe.. one realtor told me.. no worries ..the lender will eat it.. others tell me NO..it's YOU...Then i thought about lease/option.... HELP PLEASE ADVISE!

It sounds just a the few lines you have written that you have a hardship case. I agree that you need legal advice, but you also need a Realtor experienced with short sales. You need a professional who can analyze your situation and provide you with options so you can select the most workable option.

I agree with all three answers. You need to get with a real estate attorney immediately. And Lynn is absolutely correct. Short sales are not a scam. It may very well be a solution for you. I too specialize in short sales. In most cases, the difference between what you sell the home for versus what you owe is forgiven. It sounds like you have several options and I believe a qualified real estate attorney would be your best bet.

I understand that you are in a very difficult situation and to seek the advice of an attorney is wise.
It sounds like you have a few options to consider. Are you considering moving into your Dad's Villa and selling your condo that is upside down? You are in a predicament with your Dad's Villa if you cannot rent it out. So with it you could move into your Dad's Villa and sell your condo. However, to sell your condo you would have to qualify for a hardship and you indicated that you're on disability; perhaps you'd qualify for a Short Sale. I wouldn't know until I spoke with you to find out more detaisl of your financial situation. It sounds like you are getting a lot of advice and haven't stumbled across the facts yet; a qualified Real estate Attorney would be your first step. Short Sales are a great option and aren't a scam if you indeed qualify; again, check with a qualified Realtor in Short Sales.
