I have an agent who has kept me frustrated because she does not answer her phone or return my calls. She works out of her house and doesn't have a office I can go to. She lost a seller by doing the same thing to him, not answering his calls. My contract with her expired in Oct. over although I have not gotten my house keys back and we go by a day to day basis, as she always seems to have someone interested at the time I tell her I am done with her. I have left messages on her phone telling her she is fired and I want my keys back and then she finaly calls and says she has someone who will probably write up an offer. But never does. The first buyer still wants my house but refuses to use the relator. If I fire her and use another agent can she sue either of us. Or can I sell it to him without an agent (he has cash)?

I didn't see how to answer everyones questions individualy so I will answer everyone here.
#1-Dorene..my point was I did fire her. But then she would tell me she had a buyer, so it would be hard to let a possible buyer slip by. Times are very hard right now and buyers are few. But come to find out Real buyers are even fewer. I really didn't want to sign with another agent for 6 months. Even though I knew that was what I was going to need to do.
#2-The broker was her husband....it was a no win situation! I had his email address and sent him an email. Never heard from him. Also called the house/office phone. No one would answer.
#3- Jes...Somehow it all worked out. I fired the agent got my keys back and was in the process of finding another agent.... When out of the blue The old agent called me and asked if she could show the house. They had cash. I said yes. They liked it and bought it.
I guess it took the right people at the right time. I was just glad to be done with all of it.

The first step I would take is to contact the agent broker.
Dear Barbara,
If you cannot reach your real estate agent, and they are not professional and losing clients for you..my questions is..why are you stil with that agent?
If your contract is expired then you are free to choose another.
You can sell your property without an agent, but you will need some help with the contracts.
