Asked by llikins, Louisville, KY Mon Aug 5, 2013

My daughter sold her house yesterday and signed a contract. She hasn't closed yet. Now she has decided she would like to keep the house. Can she get out of the contract?

It depends on the contract. There are many rules associated with contract interpretation. Here are a few which may apply to her contract: (1) A contract is interpreted "within the 4 corners of the contract". That means that a court, when looking at how to interpret the contract, will look at what is written on the pages (the 4 corners) of the contract. (2) Courts will generally not consider "parole" evidence - oral evidence changing the written contract. (3) Ambiguity in the contract is interpreted against the person who drafted it. (4) And many others....

Even within the 7 page standard form of contract used by GLAR, there may be limited opportunities for her to attempt to avoid the contract.
