Can an exclusive right to sell contract be broken in missouri if a buyer that was dealt with before the contract was executed becomes the buyer?

We were working out details on a home in november and just recently the owner of the home signed and exclusive contract. we have never dealt with the listing realtor, only the property owner. since we were in negotiations prior to the listing can it be broken in our case?

Without seeing your contract it would be unwise to answer with any certainty, however if you need answers and don't feel the agent is giving you the information you need, always contact the Broker for additional information. The Broker of Record is always responsible for their agents' actions.

This is an issue between the Seller and the Listing Agent. If the Seller had not wanted you or other prior contacts to work through the Agent, the Seller could have excluded you from the agreement. Perhaps the Seller feels more comfortable working through an Agent knowing that he has an experienced professional watching over his interests. Whatever the case, it is not up to you the Buyer to interfere in the relationship of the Seller to the Agent. My recomendaton would be for you to acquire your own professional representation to make sure your interests are protected. After all, the Seller is the one who usually pays all commissions.

Why would you want to? If I were you I would get an Accredited Buyer's Agent to work for you and the seller will pay their agent commission and it will be split by the two agents. That way you will be protected and legal doucuments will make it a clean deal for everyone.
