All good advise here.

Call an attorney ask him/her to order the survey and then follow his/her advise.

Good luck!

Talk to the people - order and pay for a survey - hire an attorney.

First be sure they at encroaching, and ask to see the permits for the building. You will need a survey to confirm you are right, then hire an attorney.

Perhaps you should get a six pack and go talk to her first. They probably did it without a permit, so you could ask the City.

You need an attorney and they do not comment on this site.

Get a real estate lawyer before any "squatter's rights" kick in. They may have to move it, or buy that section from you for a price.

Assuming the building is immovable and you wish to remain the owner of the property, I suggest contacting a local attorney who handles real estate litigation. If a compromise cannot be reached with your neighbors, your attorney will could file suit to recover possession of the land. This could be a lengthy process. However, act quickly, because Illinois has an adverse possession statute that can bar you from commencing an action for recovery of your property if action is not taken within a certain period of time.

savefultonhouse,

Not so good news as it is going to cost you legal fees and you will also need to pay for a survey. If they are on your property sounds like a no-brainer that you would win the case but that is where your attorney comes in. Call one IMMEDIATELY. If you need a name and number send me a separate email.

Thanks

you state "...some one builds a building" as if it' a completed structure. well, one would think that as soon as there was some encroachment on your property you would have taken some action, i.e. notify the builder, see your lawyer or have Tony Soprano talk to the construction crew.

did you just watch as the building, or portion thereof, was erected/finished on your property???

regardless of the reason you didn't take any action, now it's time to contact your lawyer.

good luck
