If the hme was originally foreclosed on by MERS those foreclosures have been deemed null and void. The process has to start all over again.

While it's been a rare occurrence, it seems to be happening more often as banks are more closely scrutinizing their foreclosure procedures. And without doing it again, the bank wouldn't have clear title to the property and therefore couldn't resell the property.
If this has happened to you (as a buyer), your best bet would be to call an attorney to determine your best course of action.
