waived the home inspection b/c the seller had proof that the entire house had been remodeled. so we were about to secure the loan and wait for closing. now the seller says that they have an income restriction and we make too much money and cannot buy the house. the agent said he made a mistake. on the cutler realty page there was no mention of any type of restriction at all and the contract is signed. what can we do?.

If you want the house ask your agent to get you in touch with a good Attorney... If you don't want the hassle, move on. In my opinion this is something that should have been in the contract at the time the negotiations took place. Seems to me you are due any expenses you have incurred in the process, appraisal etc...

How important is the home to you? Assuming you will be restored to your original position (deposit's returned, fees reimbursed, etc) you might find cancelling the contract is the easiest option. I'm sure there are any number of real estate attorneys who would give you a free consultation. Good luck.

P.S. remodel or not I always recommend a pest & home inspection. Even on new construction.
