seller changed counter offer last minute...is it legal????? help!

agent called a day later and they had countered, we accepted the offer over the phone. we were waiting for the next step for a week when our agent called back and said the guy who had to approve things at the selling bank said they could not sell the house for that price....is that legal? shouldnt they have figured out how much they could sell it for before they made a counter offer? what can we do about it????

Verbal acceptance offers are legal in Ohio, but how do you prove it? If you did not initial the changes in the contract, and the bank did not sign off then you have no proof of an accepted offer. In the future, get it in writing immediately. As it stands now, it is simply your word against theirs.

What type of sale? Short Sale or Foreclosure.

In either case, when it comes down to it anything not in writing is an open door. One can only guess what actually happened from the listing side of things, but they are not legally in the wrong if you and they never signed a written counter offer.
