new owner is leasing his unit and she has moved in yesterday with a dog; rules and reg. do not permit any pet; what is next step for Assoc.?

he claims the by laws said pet allowed but 20 years ago the rules and reg. were made and that changed to no pets allowed; he did not ask anyone yet the R&R hang near the stairway where he passed before buying or renting; R&R change was by motion in minutes and renewd and a change made in 2009 to allow a dog only to visit someone , no longer than 48 hours; any help??

It sounds like a question for an attorney that represents associations. There are many Association attorneys in Florida. More than likely, your community assocation, the board of directors have an attorney that they normally consult with in regards to the established by laws.

Speak to a member of your board of directors for more information in regards to the attorney they consult with....best of luck.

Sounds like Legal to me. Consult an attorney conversant in Community Association
Law. From what you indicate - you may find what you thought got accomplished
at a meeting- didn'tt " make it " . If the Docs havn't been amended , and subsequent
Rules conflict- you May have a problem enforcing such rules!
Rules usually are promulgated by the Board but always supported by the " Doc's".
The mere posting of rules isn't what makes them " stick".You can declare
whatever you want-but to make them enforcable you must have this consistancy.
Get the help of an attorney going forward!
