I don't believe anyone even remotely challenged the legality of rebates. But the fact is, a commission rebate isn't going to be the deciding factor in whether or not a buyer can qualify for a mortgage. There are many more relevant factors involved in that decision -- credit history, income, down payment amount, debt to income ratios, available mortgage products, etc.
Anyone wondering if they can qualify financially to buy a home should be talking to a lender, not an agent.
Commission rebates are completely legal in Arizona - they're approved by the United States Department of Justice and the AZ Department of Real Estate. In fact, rebates are legal in all states but 11. The USDOJ is working to make rebates available to all U.S. home buyers. A home buyer would be foolish to not take advantage of a commission rebate, especially when the realtor offering it provides full service, experienced buyer representation.
Have them both visit with any qualified loan officer to see exactly what their buget can handle, and take it from there.

We're not actually supposed to offer paying costs from rebates or commissions to draw you in to our web of real estate.
In actuality, a rebate doesn't dictate a mortgage can be procured.
Any realtor can offer closing cost contributions, not just a rebate realtor and most of us do in spite of those that offer contributions as "rebates".
To answer your question directly, you do need to seek a lenders advice, not a realtor. There are several lenders out there and some locally owned banks offering an FHA 1% down loan.

It is very possible for your son to purchase a home especially if he is planning on buying it with someone else. Many factors have to be considered such as his disability income, credit, her income and her credit. They may also be eligible for the first time home buyer's credit. Most probably! It will depend on the amount of income he is receiving, his credit, his available amount for down payment (which can be $0 in some cases) and some other criteria.
