Noam, Both Buyer and Seller in New York, NY

multiple dwelling law.

Asked by Noam, New York, NY Tue Jun 4, 2013

Hi.
I understand that there are a few exceptions to the Multiple Dwelling Law when it comes to subleting on a daily basis.
When is it legal to sublet an apt on a daily basis? In what type of building is it legal, etc.

This is a legal issue which requires legal expertise. You might check with New York City Bar Association or LegalAid.

You cannot sublet any less than 30 days. If you rent out on a daily basis you become a hotel and/or bed and breakfast. You are not allowed to do this in any rental, condo or coop. If you own a private house you need to have a license to start a hotel business. basically, it's not allowed.
