(Vermont) The Purchase and Sale Contract is the agreement that states the terms the buyer and seller agree upon. One of the items to be agreed upon is the Closing Date. At the closing, moneys change hands, new mortgages take effect, keys are exchanged, etc. Here, agents do a walk-through of the property just before closing to ensure it is free of personal belongings not part of the sale and "broom-clean."

In Maine it specifies in our Purchase and sale agreement sales contract that all possesions and debris and substantially the same condition at the date of the sales contract. Personal belongings should be removed before the sale. After Title has been transferred, you basically do not own property and would be tresspassing if you try to remove at later date. Like anyhting else possession and occupancy is negotiable, but much cleaner if your personal belongings are out on the date of the Sale.

FIRST ANSWER
That is dependant upon the agreed date of possession in the negotiated sales contract. Each situation is different; sometimes possession comes at closing while other times it is at a later date. It is all part of the negotiating process, but does become legally binding one all parties have signed the accepted contract with the accepted date of possession.
