how do you know when your getting screwed?

our offer was acepted on a short sale, the date they were suppossed to give us an answer we had to call and find out that the negotiator no longer worked for the bank and our agent no longer worked for H.M.S so we got new agent who is our old agents dad, and he said it would be another 45 days until we got an answer

Bob is right on with this one. It is not at all uncommon for negotiators to change in the middle of the process. It is also not uncommon for a bank to claim that the can't find any of the paperwork and the process will take another 90+ days. Unfortunately, you are at the mercy of a highly imperfect system.

One thing you can try is to track down the person (Agent) working most closely with the bank. This is probably the listing or seller's agent. If you have a Real Estate Agent working with you, they need to be very aggressive and communicate with whomever is communicating with the bank.

All said, 45 days is not bad at all - the real question is how accurate or reliable is this information?

Again, put your Agent to work and find out who's communicating with the bank - your Agent can also contact the bank and help push. If you are using the same Agent that is representing the seller, you're one step closer...ask a lot of questions and make sure you're getting accurate information from the bank and the agent. Tough to say....however short sales and foreclosures do take time and LOTS of time in many cases.
You say the offer was accepted, do you have anything signed?

If you feel uncomfortable talk to the broker instead of the agent.

I can't speak to the first part of the situation but these events are not uncommon. If you receive an answer on your short sale in 45 days you're in great shape. There are some banks that take much longer dictated by the seller's exact financial situation which likely won't be disclosed to you.
