I'd check with the mortgage company and the town. It's unlikely the funds would be released without letter in hand, and obtaining homeowners insurance might be difficult. Also depending on the town's CO requirements, you might not get a CO without the letter.

FIRST ANSWER
Its possible to close without a no further action letter from the DEP. However, be prepared for a small escrow to be held until the letter is recieved.
