can anyone help me get my deposit back?!!?

my wife and I gave a deposit on a pre-construction here in florida and we want it back, can anyone help me?

There seem to be more questions than answers!!!

It has become a popular legal practice know as "Deposit Recovery"
Many attorney specialiaze in this field as the market headed south and pre-constrution buyers
feel that they over-paid. You may be entitled to all or part of your deposit based on specific reasons for wanting it back. If the developer is or was in default, a material change or modification to the plans that were provided- for example. Perhaps there was a delay in delivery, or some other substantial change ... You may be entitled to recovery.

I'm sure there are additional details..... BUT, It sounds like you should start with a good real estate attorney.

Did you use an agent?
Did they use an agent?
Has your agent tried to get your money back?
What office did the agent come from that has your money?
Agent's name and address?
How long after you signed the agreement did you cancel?
What was the exact reason you wrote for the cancellation?
Have you reviewed the purchase agreement and Addenda?
What have you do so far?

Javier,

Probably need more info on your situation. Did you sign a contract with the builder? How long ago did you sign it? What is the reason you want to cancel the contract? Have you spoken with the builder about it? What does the contract specify regarding deposits? Did you have a REALTOR represent you in the transaction?

If you did sign a contract and did not have a REALTOR that you can consult with, and the builder is not receptive to returning your deposit, depending on what the specifics of your contract are, you may need to consult with an attorney.
