Thank you. I have tried to get the disclaimer from the bank agent but unfortunatly he did not know about it & have not gotten back to us.
I was walking around the complex & one of the owner told me go see the disclaimers before you place an offer. There are 3 more similair apt for sale & the statues is pending.
I am looking to buy something around $160k cash & this one in Newberry in hayward was $160k.

Unfortunately, 99 percent of all lawsuits against the developer are due to "construction defects" within the community. However, it's important to determine what, exactly, is the source of the problems. "Construction defects" can be as small as windows with broken seals to problems as great as the building is sinking. Once the homeowners association commences a lawsuit against the developer, home sales come to a halt since most lenders will not fund loans for any homes in which a community has commenced or is in the process of litigation. So if the home that you want to buy has started litigation, be aware that your lender may not be willing to provide a loan due to the lawsuit.
To learn more about the nature of the lawsuit, contact the listing agent and owner. Only the owner of the home may request information from the homeowners association, and the HOA may be the only entity with answers right now.

You need to talk to the residents or owners in the community.
See if any of the residents or owners are outside and tell them that you are interested in buying a condo, but heard that they are suing the builders
Check and see if that is affecting the HOA in any way.
