203(K) Limited Streamline Contractor Conflict of Interest definitions

When obtaining a 203(K) streamline in PA, is it considered a conflict of interest when using a contractor that you are related to only through marriage? Some underwriters say yes, some say no, and I am totally confused. HELP! The loan itself if only in my husbands name, my name doesn't appear anywhere, the contractor is my brother and the underwriters seem to be arguing about it. HUD tells us that it is not a conflict according to state laws and so do some of the mortgage specialists and underwriters. They sent us approval papers then turned around and said we couldn't do it. I'm confused and this has completely changed everything. We were supposed to close on August 26th, and haven't because of this. Our real estate guy is getting upset and I'm not sure what to do. Any advice?
