At the latest city council meeting it was announced there might be pending litigation against Toll brothers.
The planning commission will be reviewing the Promenade project Tuesday night. Thanks for the heads up Frienze. This story only proves what dirtbags Toll Brothers are. Most residents in the Villages are extremely upset and hopefully everyone can let the media know what is going on here. I encourage all residents to email the media. I just emailed Kron4.com at 4listens@kron4.com and I encourage more to do the same.
Hate the fact how Toll is holding on to Sheryl S's deposit just like theirs is being held on to. Does it sound like Toll is a fair buisness. U decide.

You asked a great question. Pending lawsuits are never good in any context, and builders like Toll Brothers often do not take such drastic legal action unless a lot of money is on the line. Because the City of Dublin has been and continues to be extremely developer-friendly, the fact that this unknown issue has reached the level of "anticipated litigation" should be troubling for everyone. As we all know, taking a case to court costs a lot of money. No matter who wins the case, longtime residents of and new arrivals to the City of Dublin will be expected to pay in the form of higher taxes or service level reduction in the end. When you see the issue in this light, most reasonable people will choose to buy in a city without pending litigation over a city with pending litigation. The best outcome for everyone involved is for Toll Brothers to work collaboratively with the City of Dublin, before legal cost gets too out of hand for both parties. Dublin is a wonderful city. I certainly am not trying to dissuade people from buying here, but because virtually no detail is available regarding this anticipated litigation, the safest option for any home prospective home buyer is to wait for more details to come forth before closing on a house. You'll find that Realtors are summarily excluded from the unlicensed practice of law. Therefore we cannot draw legal conclusions and advise of same.
However, there is a place in the MLS where the listing agent must fill in "Pending Litigation" Y or N.
The buyer's agent then requests a summary of the pending litigation and provides it to the customer.
It is then the customer's option to review and/or seek legal advice.
I went through this process just yesterday and the buyer has opted not to proceed.
From what you have said [might be] there aren't enough details for anyone to draw any conclusions yet.
