I called this agent and she said she would not take any offers on this home as it had an offer on it already. (that was not accepted and was waiting on managment to sign off on it) So I called another agent and she says MLS has this as active and would call the listing agent. A few hours later the second agent called me back and said there was something funny going on because the TMS # did not match and the Listing agent said she would not take any back up offers either. I then called Fannie Mae and they said they had no offers on record at all and show this home as just listed. What gives here? Is this listing agent holding this for herself? Is this legal???
My offer would be a full offer with no contingencies and all cash with POF.

Submit your offer to the agent/BIC. Explain your conversation with Fannie to the listing agent.
The Fannie Mae rep said he would see an inbound offer in the system but that the acceptance wouldnt show. He assured me no offers had been received to date. He also advised me to make an offer and that Fannies policy would be to look at all offers before accepting any offers. But the listing agent it saying something totally different.
The listing agent is the BIC.
It is quite possible the person you spoke with at Fannie Mae did not know an offer had been verbally accepted, and the listing agent is just waiting on the executed contract to be sent back. A common case of the right hand does not know what the left hand is doing.
Or it could be something fishy. You could always ask to speak with the Broker in Charge at the listing company to get more details/results regarding this situation if you feel something is not right.
