Since your purchase agreement indicates the Seller will be responsible for all section 1 repairs, then seller must cover those charges. However, I recommend that you have your termite company inspect the property before any repairs are made. That way should there be any major differences between the two termite companies reports you will be in a better position to question the differences. You may then request that your termite report be chosen rather than the seller's. If you wait until the repairs are made, then you will be in a position of having to battle it out with the Seller's termite company to make those additional repairs that they missed. We are in escrow right now. We asked the seller to take care of section 1 but not sure what would happen if the termite repair reveals more damage. Also, we'll be using our termite inspector to re-inspect once seller's contractor finish w/ all the repairs. What would be the consequence if there is discrepancy between the two reports? Thanks.
Trying to figure out where you are in the home buying process. Are you still in escrow? Were these additional repairs found while the termite company was making the repairs from the original inspection? Did the purchase agreement determine that the Seller's would pay for Section 1 repairs, and the Buyer's would pay for Section 2 repairs? Or Did you pay for your own termite inspection report?
