Who pays the city transfer tax in San Jose? Is it commonly split btw seller and buyer?

Hi Lisa,
As with all terms of the contract, costs are negotiable, but most people follow the customary practice in Santa Clara Co. and split the San Jose city tax 50/50. There is also a Santa Clara County transfer tax and by custom, the seller alone pays this.

One more for split 50/50 buyer/seller. San Jose's city tax is $3.30 per thousand dollars of purchase price.

It's commonly and customary in Santa Clara County that City Transfer Tax split btw seller and buyer. However, it depends on the signed contract btw seller and buyer.
