Who pays country and city transfer tax in Mountain View, CA for new construction?

Asked by Sumit Singh, Mountain View, CA Sun Jul 22, 2012

I am about to buy a new townhouse at Mondrian (by Shea Homes) and would like to know who (buyer/seller) pays county (1.1/1000) and city (3.3/1000) transfer tax?

Congratulations on your new home, Sumit!

As always in real estate transactions, fees paid by each party are negotiable.

In Mountain View, *typically* the seller pays:

Documentary Transfer Tax ($0.55 per $500 of the purchase price), and
50% of the City Transfer Tax ($1.65 per $500 of the purchase price). Note that the buyer generally pays the other 50% of the City Transfer Tax.

Additionally, the seller generally pays the Title & Escrow Fees.

Always check your Real Estate Purchase Agreement to confirm your payment offer, and better yet, have a discussion with your Realtor before you submit your offer to see what makes sense for your situation.

Generally the Seller pays the City $1.10 per $1000 and the buyer and seller split the county $3.30 per $1000.
