What options do buyers have if seller is delaying the scheduling of closing?

We signed a contract to purchase a home in late January, with a "Close on or about date of 2/22/2013". We were notified that we were clear to close on 2/21/2013, at which point we were notified through our attorney that the seller required 2 weeks notice to schedule the closing in order to give notice at work. A closing date was not set, and now the seller states that 3/14 is the earliest possible closing date, but more time would be preferable for the seller. We have some time before our rate lock expires, but do not want to see the closing delayed longer than absolutely necessary. What options might we have?

I agree with Anna; your optimal option is to consult with your attorney!! He or she can is equipped to provide you with options that conform to the parameters of your contract. Good luck.

On or about gives you and the seller 30 days beyond to close. That means they do not have to close before 3/22/13. Do you have an okay to close? If not then it is too early to schedule a closing. If you have the okay then schedule the closing.

My suggestion is to discuss a "time is of the essence" letter with your attorney.

Hi Rebecca,

Anna is right and your attorney is the person you should be contacting. Do you have a buyer's agent? Sometimes agents have a bit more insight into the reasoning of sellers than attorneys do, but the only person who can legally advise you is your attorney.

I would be frustrated as well, but if you have upheld your end of the contract, you will have the right to close.
